Art. 25 Start-up and innovative incubator certificate: purpose, east lothian courier design and advertising 1 These provisions are designed to encourage sustainable growth, technological development, employment, youth in particular, with regard to innovative start-up companies, as defined in section 2 and in line with what is identified in the National Reform Programme 2012, published as an annex to the document Economics and Finance (DEF) of 2012 and with the guidelines and recommendations issued by the Council of Ministers of the European Union. The provisions of this section, contextually intend to contribute to the development of new entrepreneurial culture, the creation of a better ecosystem for innovation, so as to promote greater social mobility in Italy and attract talent and capital from abroad.
2 For the purposes of this Decree, the firm innovative start-up, referred to as' innovative east lothian courier start-up, "is a corporation, incorporated in the form of cooperatives, under Italian law or a Societas Europaea, a resident of Italy pursuant to Article east lothian courier 73 of the Decree east lothian courier of the President of the Republic on 22 December 1986, no. 917, whose shares or shares representing the capital stock are not listed east lothian courier on a regulated market or an MTF, which meets the following requirements:
d) starting from the second year of the innovative start-up, the total value of annual production, as well as the latest balance sheet approved within six months of the financial year, shall not exceed EUR 5 million;
1) expenditure in research and development are equal to or greater than 30 per cent of the greater of cost and total value of production of the innovative start-up. From the calculation east lothian courier for expenses in research and development expenses are excluded for the purchase of real estate. The expenses are approved financial statements and are described in the notes. In the absence of budget in the first year of life, their execution is taken by a statement signed by the legal representative of the innovative start-up;
2) use as employees or in any capacity, as a percentage equal to or greater than the third of the total workforce, personnel in possession of a Ph.D. or who is doing a PhD at an Italian or foreign, or in possession of a degree and who has held for at least three years research at certified public research institutes or private, in Italy or abroad;
3) is the owner or licensee of at least one industrial patent on an invention of industrial biotechnology, a topography of semiconductor product or a new plant variety east lothian courier directly related to the corporate purpose and to the business.
3 The companies already in existence on the date of enactment of this decree and meet the requirements specified in paragraph 2, are considered innovative start-ups for the purposes of this Decree, if within 60 days of the date of the log file with the Office of the companies referred to in Article 2188 of the Civil Code, a declaration signed by the legal representative certifying the possession of the requirements of subsection 2 In this case, the rules provided for in this section is applicable for a period of four years from the date of entry into force of this decree, if the innovative start-up has been established east lothian courier within the previous two years, three years, has been established within the previous three years and two years, has been established east lothian courier within the four previous years.
4 For the purposes of this Decree, are start-ups in the social vocation innovative start-ups referred to in paragraphs 2 and 3 that operate exclusively in the areas referred to in Article 2, paragraph 1, of Legislative Decree 24 March 2006 n. 155.
